Heroic Crime of the Century could only be activated while Moriarty was on the field. Even though Sherlock & James was a Fusion of the two, and they were essentially just standing closer together, the rules were the rules. Without Heroic Spirit – James Moriarty, the Trap couldn't be used.
"You don't need to worry about that. Instead of using Heroic Crime of the Century to break your field, I have a better option—so long as I first seal away your troublesome Vessel of the Saint."

Holmes pointed at Hoshino's deck. "After Hero Creation, the top card of your deck should be a Monster Card—[Heroic Spirit – Cú Chulainn]."

Using Emiya Alter's effect, Holmes retrieved the Quick-Play Spell Heroic Spirit – Emergency Summoning from his Graveyard.
